TERMS:
The property is being sold “AS IS, WHERE IS” with any and all faults and existing condition(s) and without any express or implied warranty as to the nature, condition and description of such land and improvements or its fitness for any use or purpose and subject to completion of a proper title examination disclosing any outstanding liens or encumbrances or otherwise. No claim will be considered for allowance or adjustment or for rescission of the sale based on failure of the property to conform to any expressed or implied representation or the condition of the property whatsoever. Please review all information available and seek appropriate assistance prior to attending and bidding at the auction. Announcements made at the day of sale take precedence over written material and prior oral statements. Property is subject to prior sale.

Buyer will immediately pay ten-percent (10%) of his/her/its winning bid price as a down payment/deposit to be applied toward the purchase price or as otherwise herein set forth, and immediately sign the contact to purchase such property after being declared the Buyer on the day of the Auction and will pay the balance due for the winning bid price plus all settlement costs of Buyer by certified check or cashiers check at closing/delivery of deed, within 30 days of the sale date. All real estate property taxes, utility costs, city assessments and related items will be prorated as of the date of closing.

If payment of the balance does not take place within the specified time (unless the Buyer/Successful Bidder and Seller otherwise agree in writing) the deposit will be forfeited to Seller and the property may be resold by Seller at the risk of such successful bidder. The property will be sold in an "AS IS, WHERE IS" condition, without express or implied warranty as to the nature and description of the improvements or land as contained herein. The Buyer/Successive bidder assumes risk of loss from day of sale. All costs to complete a resale of such property by Seller shall be borne by the Buyer/Successful bidder. If the Seller is unable to convey good and marketable title, the Buyer's sole remedy in law or equity shall be limited to the refund of the deposit.
